OSEAS AGUILAR-GUZMAN, a 38-year-old native of Guatemala, pleaded guilty on July 14 to the charge of reentry of a removed alien in violation of Title 8, United States Code, Section 1326(a), according to an announcement by U.S. Attorney David I. Courcelle. Sentencing is scheduled before Chief U.S. District Judge Wendy B. Vitter on October 13.
According to the charging document, Aguilar-Guzman was found in the United States on March 20 after previously being deported on December 4, 2013. He had not received authorization from the Attorney General or the Secretary of the Department of Homeland Security to reenter.
Aguilar-Guzman faces a maximum sentence of two years in prison, a fine of up to $250,000, up to one year of supervised release, and a mandatory special assessment fee of $100.
The case is part of Operation Take Back America, described as a nationwide initiative that uses Department of Justice resources “to repel the invasion of illegal immigration, achieve the total elimination of cartels and transnational criminal organizations (TCOs), and protect our communities from the perpetrators of violent crime.”
Courcelle praised U.S. Immigration and Customs Enforcement for its investigative work in this matter. Assistant United States Attorney Shannon Kippers from the General Crimes Unit is prosecuting.
