During consideration of this measure today, Senate also took the following action:

By 46 yeas to 50 nays (Vote No. 29), three-fifths of those Senators duly chosen and sworn not having voted in the affirmative, Senate rejected the motion to waive all applicable sections of the Congressional Budget Act of 1974, with respect to Wyden/Schumer Amendment No. 3395 (to Amendment No. 3378), to provide for comprehensive provisions for the prevention and enforcement of opioid abuse and treatment of opioid addiction. Subsequently, a point of order that pursuant to Section 302(f) of the Congressional Budget Act of 1974 the amendment would cause the underlying legislation to exceed the authorizing committee's section 302(a) allocation of new budget authority or outlays was sustained, and the amendment fell.

By 48 yeas to 47 nays (Vote No. 30), three-fifths of those Senators duly chosen and sworn not having voted in the affirmative, Senate rejected the motion to waive all applicable sections of the Congressional Budget Act of 1974 and applicable budget resolutions with respect to Shaheen/Whitehouse Amendment No. 3345 (to Amendment No. 3378), to make appropriations to address the heroin and opioid drug abuse epidemic for the fiscal year ending September 30, 2016. Subsequently, a point of order that pursuant to Section 311(a)(2)(A) of the Congressional Budget Act of 1974 the amendment would cause the aggregate level of budget authority and outlays for fiscal year 2016 as established in the most recently agreed to concurrent resolution on the budget, S. Con. Res. 11, to be exceeded was sustained, and the amendment fell.
