Our position that U.S. courts have no jurisdiction over non-U.S. citizens being held in military control abroad is based on long-standing Supreme Court precedent. This position has been upheld unanimously by the D.C. Circuit Court of Appeals with respect to the detainees in military control at Guantanamo Bay. The Supreme Court is reviewing the issue. 03-712
