O’Connor, Assistant Attorney General for the Tax Division, issued the following statement regarding Black & Decker v. United States of America, a “contingent liability” tax shelter case filed in U.S. District Court for the District of Maryland. The court today granted Black & Decker’s motion for summary judgment: “We are disappointed in the court’s decision. We believe our position in this case is supported by the facts and the relevant law. The Department is considering its options.” 04-713
