As the Solicitor General argued in this case, the Ninth Circuit Court of Appeals had created a standard that was unduly narrow and prevented victims from bringing civil court cases even on the assumption that companies have actively induced others to violate federal copyright laws on a massive scale. The Department of Justice remains strongly committed to the enforcement of intellectual property rights, and we will continue to support the ability of victims of intellectual property theft to pursue remedies for infringement in the civil courts. 05-342
