Energy and Commerce Chairman Frank Pallone, Jr. (D-NJ) released the following statement today as the 5th Circuit Court of Appeals hears oral arguments in Texas v. United States, which could overturn the entirety of the Affordable Care Act (ACA) and strip away health care from tens of millions of Americans:
“The health and wellbeing of tens of millions of Americans is on the line today as Republicans continue their ongoing assault on our nation’s health care. If this disastrous lower court decision is upheld by the 5th Circuit, 20 million Americans will lose their health insurance and 130 million Americans could once again face discrimination for pre-existing conditions.
“This is a baseless lawsuit, but Republican appointed judges continue to throw all legal judgment aside in an effort to undermine the ACA and our nation’s health care system. President Trump and Republican lawmakers nationwide are aware of the devastating impacts this lawsuit would have on the American people, but they simply do not care. While the Trump Administration refused to do the right thing and defend the law, Democrats will continue to fight to protect health care for tens of millions of Americans."
