Rochester Man Pleads Guilty to Gun Charges

BUFFALO, N.Y. - U.S. Attorney James P. Kennedy, Jr. announced today that Joseph Cavico, Jr., 50, of Rochester, NY, pleaded guilty before U.S. District Judge Richard J. Arcara to possession of firearm with obliterated serial number. The charge carries a maximum penalty of five years in prison and a $250,000 fine.

Assistant U.S. Attorneys Scott S. Allen, Jr. and Paul C. Parisi, who are handling the case, stated that on Dec. 15, 2017, law enforcement officials from the LeRoy Police Department responded to a domestic dispute in LeRoy, New York. Upon arrival, officers saw Cavico on top of a female, assaulting her, with a pistol at his side. The pistol’s serial number had been obliterated.

The defendant has three prior felonies dating back to 1990 and is legally prohibited from possessing a firearm.

The plea is the result of an investigation by the Bureau of Alcohol, Tobacco, Firearms, and Explosives, under the direction of Special Agent-in-Charge Ashan Benedict, New York Field Division; the LeRoy Police Department, under the direction of Chief Christopher Hayward; and the Genesee County Sheriff’s Office, under the direction of Sheriff William Sheron, Jr.

Sentencing is scheduled for Sept. 13, 2018, at 12:30 p.m. before Judge Arcara.
