Baltimore, Maryland -U.S. District Judge George L. Russell III sentenced Robert Fitzgerald, age 35, of Baltimore, today to 130 months in prison followed by three years of supervised release for being a felon in possession of a firearm and ammunition, and possession with intent to distribute heroin and marijuana.
The sentence was announced by United States Attorney for the District of Maryland Rod J. Rosenstein; Special Agent in Charge William P. McMullan of the Bureau of Alcohol, Tobacco, Firearms and Explosives - Baltimore Field Division; Baltimore City State’s Attorney Gregg L. Bernstein; and Baltimore Police Commissioner Anthony W. Batts.
According to court documents, on Oct. 16, 2012, Baltimore Police detectives executed a search warrant at Fitzgerald’s residence and seized 44 zip lock bags containing heroin, packaging material and other drug paraphernalia, a digital scale, 36 zip lock bags containing marijuana, a food saver clear plastic bag with marijuana, $1,284, a loaded.32 caliber revolver, a.22 revolver and a box of ammunition with.32 caliber rounds.
Fitzgerald had previously been convicted of a felony and was prohibited from possessing a firearm and ammunition.
United States Attorney Rod J. Rosenstein commended the ATF, Baltimore Police Department and Baltimore City State’s Attorney=s Office for their work in the investigation. Mr. Rosenstein thanked Special Assistant United States Attorney H. Brandis Marsh, Jr., a cross-designated Baltimore City Assistant State’s Attorney assigned to Exile cases, who prosecuted the case.
