U.S. Attorney Kenneth A. Polite announced that HERBERT COOPER, age 41, and RICHARD WILLIAMS, age 38, both residents of New Orleans, Louisiana, were charged today in a three-count indictment for violations of the Federal Controlled Substances Act. According to the indictment, on Oct. 24, 2014, COOPER and WILLIAMS conspired to distribute and to possess with the intent to distribute over 28 grams of crack cocaine, in violation of Title 21, United States Code, Section 846. WILLIAMS was also charged with distributing at least 28 grams of cocaine base, in violation of Title 21, United States Code, Sections 841(a)(1), and 841(b)(1)(B). Additionally, COOPER was charged with possessing with the intent to distribute at least 28 grams of cocaine base, in violation of Title 21, United States Code, Sections 841(a)(1) and 841(b)(1)(B).
If convicted, COOPER and WILLIAMS each face a maximum term of 40 years imprisonment as to each count, a fine of up to $5,000,000, a period of four years of supervised release following any term of imprisonment, and a special assessment of $100.00.
U.S. Attorney Polite reiterated that the indictment is merely a charge and that the guilt of the defendant must be proven beyond a reasonable doubt.
U.S. Attorney Polite praised the work of the Drug Enforcement Administration, with assistance from the New Orleans Polite Department in investigating this matter. Assistant United States Attorney Brandon S. Long is in charge of the prosecution.
