United States Attorney Brendan V. Johnson announced that a Denver, Colorado, man has been indicted by a federal grand jury for Possession with Intent to Distribute a Controlled Substance.
Brandon Jeraye Trejo, age 22, was indicted on December 9, 2014. He appeared before U.S. Magistrate Judge Mark A. Moreno on Dec. 10, 2014, and pled not guilty to the Indictment.
The maximum penalty upon conviction is up to 20 years in custody and/or a $1,000,000 fine, a mandatory 3 years up to life of supervised release, and $100 to the Federal Crime Victims Fund. Restitution may also be ordered.
The Indictment alleges that on or about Nov. 14, 2014, Trejo knowingly and intentionally distributed, and possessed with intent to distribute, a detectable amount of methamphetamine, a Schedule II controlled substance.
The charge is merely an accusation and Trejo is presumed innocent until and unless proven guilty.
The investigation is being conducted by the South Dakota Highway Patrol and the Northern Plains Safe Trails Drug Enforcement Task Force. Assistant U.S. Attorney Jay Miller is prosecuting the case.
Trejo remains in custody pending release on bond. A trial date has not been set.
