MADISON, WIS. -- A federal grand jury in the Western District of Wisconsin, sitting in Madison, returned the following indictments today. You are advised that a charge is merely an accusation and that a defendant is presumed innocent until and unless proven guilty.
The maximum statutory sentence is prescribed by Congress and is provided here for informational purposes. If convicted, the sentencing of a defendant will be determined by the court based on the advisory Sentencing Guidelines and other statutory factors.
Florida Man Charged with Installing Skimmers At Madison Gas Stations
Alejandro Arias-Perez, 29, Miami, is charged with two counts of possessing device-making equipment (a skimming device) with the intent to defraud. Originally, Arias-Perez was charged with these offenses in a complaint filed in U.S. District Court in Madison on April 27. Federal law requires that cases charged by complaint be presented to a grand jury within 30 days.
The complaint and indictment allege that Arias-Perez installed a gas pump skimmer at two gas stations in Madison, in order to fraudulently obtain credit card numbers from customers of the gas stations. The two gas stations were located on East Washington Avenue and South Park Street.
Arias-Perez was arrested in Miami and made an initial appearance in federal court there on April 28. He remains in federal custody and will be transferred to the Western District of Wisconsin. No date has been set for his initial appearance in federal court in Madison.
If convicted, Arias-Perez faces a maximum penalty of 20 years in federal prison on each count. The charges against him are the result of an investigation by the Federal Bureau of Investigation, Madison Police Department, and the City of Madison’s Bureau of Weights and Measures. The prosecution of this case will be handled by Assistant U.S. Attorney Aaron Wegner.
Eau Claire Man Faces Drug & Gun Charges
Kong Meng Lee, 27, Eau Claire, Wis., is charged with possessing methamphetamine with intent to distribute. The indictment also charges him with possessing a firearm in furtherance of that drug crime. The indictment alleges that he possessed the methamphetamine and a 9mm caliber handgun on Nov. 29, 2016.
If convicted, Lee faces a maximum penalty of 20 years in federal prison on the drug charge, and a mandatory penalty of five years on the charge of possessing a firearm in furtherance of a drug crime, which would be served consecutively to any prison term imposed on the drug charge. The charges against him are the result of an investigation by the Eau Claire Police Department, Drug Enforcement Administration, and Bureau of Alcohol, Tobacco, Firearms and Explosives. The prosecution of this case will be handled by Assistant U.S. Attorney Antonio Trillo.
Chetek Man Charged with Possessing Methamphetamine with Intent to Distribute
Jason J. Johnson, 44, Chetek, Wis., is charged with possessing methamphetamine with the intent to distribute. The indictment alleges that he possessed the methamphetamine on December 6, 2016.
If convicted, Johnson faces a maximum penalty of 20 years in federal prison. The charge against him is the result of an investigation by the Barron County Sheriff’s Department. The prosecution of this case will be handled by Assistant U.S. Attorney Robert Anderson.
Three Illinois Men Charged with Possessing Cocaine with Intent to Distribute
Samuel Robles, 27, Saul Ivan Robles, 24, and Daniel Herrera, 19, all of Rockford, Ill., are charged with possessing 500 grams or more of cocaine with intent to distribute. The indictment alleges that they possessed the cocaine on May 5, 2017. Samuel Robles and Saul Ivan Robles are brothers.
If convicted, each defendant faces a mandatory minimum penalty of five years and a maximum penalty of 40 years in federal prison. The charge against them is the result of an investigation by the Drug Enforcement Administration. The prosecution of this case will be handled by Assistant U.S. Attorney Timothy O’Shea.
