MADISON, WIS. -- A federal grand jury in the Western District of Wisconsin, sitting in Madison, returned the following indictment today. You are advised that a charge is merely an accusation and that a defendant is presumed innocent until and unless proven guilty.
The maximum statutory sentence is prescribed by Congress and is provided here for informational purposes. If convicted, the sentencing of a defendant will be determined by the court based on the advisory Sentencing Guidelines and other statutory factors.
Justin Kohl, 30, Waupun, Wis., is charged with conspiring with Christopher Dutton, Brandon Frank, and others known and unknown to the grand jury, to distribute 50 grams or more of methamphetamine. The indictment alleges that the conspiracy operated from November 2016 to March 2017.
Kohl is also charged with two counts of possessing methamphetamine with the intent to distribute. The indictment alleges that he possessed methamphetamine on January 7 and 12, 2017.
Dutton and Frank were indicted by the grand jury on March 29 for conspiring to distribute methamphetamine. Their trial date is set for December 4, 2017.
If convicted, Kohl faces a mandatory minimum penalty of five years and a maximum penalty of 40 years in federal prison on the conspiracy charge, and 20 years in federal prison on each of the possession with intent to distribute charges.
The charges in this methamphetamine conspiracy are the result of an investigation by the Wisconsin Department of Justice Division of Criminal Investigation; Drug Enforcement Administration; Dane County Narcotics Task Force; Dane County Sheriff’s Department; Madison Police Department; UW-Madison Police Department; U.S. Postal Inspection Service; Sauk County Drug Task Force; Richland-Iowa-Grant Drug Task Force; Lafayette County Sheriff’s Office; State Line Area Narcotics Team; and Rock County Special Investigations Unit. The prosecution of Justin Kohl is being handled by Assistant U.S. Attorney Diane Schlipper.
