Romanian Man Sentenced for Illegal Re-entry into United States

ALBANY, NEW YORK - Gabriel Vasile Lincan, age 47, and a citizen of Romania, was sentenced today to time served (47 days in jail), for illegal re-entry into the United States.

The announcement was made by United States Attorney Grant C. Jaquith and Robert N. Garcia, Chief Patrol Agent, United States Border Patrol, Swanton Sector.

Lincan was arrested by Border Patrol Agents in Champlain, New York, after he was caught entering the United States from Canada without inspection on Oct. 3, 2018. Lincan had previously been removed from the United States to Romania on Sept. 1, 2017. Lincan admitted that he returned to the United States without permission following the September 2017 removal.

Following the sentencing, Lincan was remanded to the custody of the Department of Homeland Security, for removal proceedings.

When Lincan entered the United States, he did so with his son, Gabriel Diego Constantin. Constantin, age 20, also a citizen of Romania, was convicted of the misdemeanor offense of entry without inspection on Oct. 11, 2018 and sentenced to 23 days in jail.

This case was investigated by Border Patrol and prosecuted by Assistant U.S. Attorney Edward P. Grogan.
