The National Right to Work Committee stated that President Joe Biden aims to "secure a Senate rubberstamp" to extend Lauren McFerran’s term, potentially allowing "radical nominees" to lead the National Labor Relations Board (NLRB) until August 2026. The statement was made in an Aug. 24 post on X.

"Joe Biden wants to quickly secure a Senate rubberstamp to keep Lauren McFerran, the NLRB's rabidly anti-Right to Work chairman, on the Board for another five years," said Right to Work Committee. "If he succeeds, his radical nominees will remain in control of the Board until August 2026."

According to the committee, former President Donald Trump is leading in polls, and President Biden is working to extend McFerran’s term as NLRB chairman, which could maintain pro-union control of the board until August 2026. The committee noted that McFerran’s NLRB has taken positions viewed by some as more extreme than those of the previous Obama-era board. This includes decisions like the Cemex case, which allows unions to gain power without elections, and proposed changes that might hinder worker-led efforts to decertify unions.

Lauren McFerran has been a member of the NLRB since Dec. 17, 2014, and was reappointed for a term ending Dec. 16, 2024. She became NLRB chairman on Jan. 20, 2021. Previously, McFerran served as chief labor counsel and deputy staff director for the Senate Health, Education, Labor and Pensions (HELP) Committee and worked as a labor attorney and law clerk. She holds degrees from Rice University and Yale Law School.

The National Right to Work Committee is a grassroots organization focused on opposing compulsory union membership and dues. It represents a coalition of 2.8 million individuals, including workers and small business owners, who advocate for the right of employees to choose whether or not to join a union without facing job loss or other penalties.
