Department of Education releases new resources to aid compliance with amended Title IX regulations

The U.S. Department of Education’s Office for Civil Rights (OCR) has released two new resources to assist schools in complying with the 2024 amendments to Title IX Regulations, which took effect on August 1, 2024. These resources aim to clarify and update obligations related to Title IX coordinator duties and prohibitions on sex discrimination based on pregnancy or related conditions, as well as parental, family, or marital status.

The first resource, "2024 Title IX Regulations: Impact on Title IX Coordinator Duties," outlines new and updated requirements for Title IX coordinators. It addresses questions such as the necessary training for a Title IX coordinator, steps they must take upon notice of possible sex discrimination, and actions related to students who are pregnant or experiencing pregnancy-related conditions.

The second resource, "2024 Title IX Regulations: Nondiscrimination Based on Pregnancy or Related Conditions & Parental, Family, or Marital Status," clarifies prohibitions on sex discrimination for students, employees, and applicants for admission or employment. It answers questions about what constitutes “pregnancy or related conditions,” how Title IX applies to “parental status,” and the provisions schools must make for lactation time and space.

These resources supplement previously released technical assistance documents aimed at implementing the 2024 Title IX Regulations. These include a summary of major provisions; guidelines for drafting nondiscrimination policies; pointers for implementation; and a small entity compliance guide.

However, as of August 28, 2024, federal court orders have enjoined the Department from enforcing the 2024 Final Rule in several states including Alabama, Alaska, Arkansas, Florida, Georgia, Idaho, Indiana, Iowa, Kansas Kentucky Louisiana Mississippi Missouri Montana Nebraska North Dakota Ohio Oklahoma South Carolina South Dakota Tennessee Texas Utah Virginia West Virginia Wyoming The enforcement is also paused at certain schools listed online. Pending further court orders the Department's amended 2020 Final Rule remains in effect in these states and schools
