Marco’s Pizza franchisee fined $207K for child labor violations

The U.S. Department of Labor has uncovered child labor violations at two Marco’s Pizza locations in Knoxville, Tennessee. The investigation revealed that the franchisee, Deliver Magic LLC and Deliver Magic II LLC, along with owner Stephen Petrone, employed minors in hazardous tasks and allowed them to work beyond legally permitted hours.

The department's Wage and Hour Division found that 20 children were tasked with disassembling and cleaning dough sheeters, a violation under the Fair Labor Standards Act (FLSA). Additionally, 15-year-olds were engaged in cooking and baking activities prohibited for their age group under federal law. Furthermore, 11 workers aged between 14 and 15 were employed past 7 p.m., which is not allowed between Labor Day and June 1.

In response to these findings, the employer has agreed to an enhanced compliance agreement with the Department of Labor and paid $207,486 in civil penalties. "Learning new skills in the workforce is an important part of growing up, but we must protect children and ensure their first jobs are safe and never interfere with their education or well-being," stated Lisa Kelly, Wage and Hour Division District Director in Nashville.

Deliver Magic LLC has committed to several measures to prevent future violations. These include prohibiting minors from engaging in hazardous occupations such as handling dough sheeters, ensuring adherence to legal working hours for young employees, updating training materials on FLSA compliance, requiring annual review of child labor laws by management staff, and implementing uniform modifications for workers under 16.

This case is part of a broader effort by the Department of Labor to address child labor violations across the country. In fiscal year 2024 alone, investigations have identified over 4,000 affected children nationwide resulting in more than $15 million in penalties assessed against employers.
