The National Federation of Independent Business (NFIB) Small Business Legal Center has been actively involved in filing amicus briefs in various courts across the United States. The organization, alongside other business associations, is addressing significant issues affecting small businesses.
In the case of Bowfin Keycon Holdings, LLC v. Pennsylvania Department of Environmental Protection and Shirley v. PA Legislative Reference Bureau, NFIB has joined forces with the Pennsylvania Manufacturers Association, the Pennsylvania Energy Consumer Alliance, and the Pennsylvania Chamber of Business and Industry. They are urging the Pennsylvania Supreme Court to support a challenge against Pennsylvania’s Regulation 7-559, also known as the CO2 Budget Trading Program.
In another matter, Leachco v. Consumer Product Safety Commission, NFIB is asking the U.S. Supreme Court to decide on whether the structure of the Consumer Product Safety Commission (CPSC) aligns with constitutional principles regarding separation of powers.
At the Alabama Supreme Court, in Ex Parte INV Performance Surfaces, LLC, NFIB and the Chamber of Commerce have submitted a brief challenging personal jurisdiction over entities located outside Alabama.
The Seventh Circuit Court of Appeals is reviewing Richards v. Eli Lilly. In this case, NFIB filed a brief that questions which method should be used to determine plaintiff eligibility in collective action lawsuits under the Fair Labor Standards Act (FLSA).
Additionally, in Texas Chemistry Council v. EPA at the Fifth Circuit Court of Appeals, NFIB argues for strict adherence by the U.S. Environmental Protection Agency (EPA) to applicable statutes for the benefit of small businesses.
