OPINION: Biden Is Handing New Administrations a Powerful Tool to Politicize Foreign Investments

The Biden administration’s recent move to sharpen the powers of the Committee on Foreign Investment in the United States (CFIUS) is a well-intentioned effort to protect national security. However, President Biden may be inadvertently handing new Administrations a powerful tool to politicize foreign investments and weaponize economic policy.

CFIUS, traditionally a quiet inter-agency board, has the critical task of reviewing foreign investments in U.S. companies to ensure they don’t threaten national security. By expanding CFIUS’s authority, including significantly increasing penalties for violations, the Biden administration aims to better safeguard vital industries from foreign interference. While this is crucial in an era of growing geopolitical tensions, especially with China, the enhanced powers could have dangerous political implications.

With a more powerful CFIUS, there’s a real risk that foreign investment decisions could be influenced by political motives rather than genuine national security concerns. Administrations could exploit these enhanced CFIUS tools to target companies and countries based on ideological lines, rather than objective threats.

This isn’t just a hypothetical concern. Even in current discussions, national security is being referenced as a pretext for imposing tariffs and other economic measures for other political means. By giving CFIUS more authority without carefully considering the potential for abuse, the Biden administration might be setting a dangerous precedent. The enhanced CFIUS could become a weapon to stifle foreign competition selectively or to advance a partisan economic agenda, undermining the very principles of fair trade and global cooperation that the U.S. has long championed.

In strengthening CFIUS, Biden is doing what he believes is necessary to protect the country. But, he must also recognize that these new powers could easily be misused by any Administration that does not share his commitment to impartial governance. The consequences could be severe—not just for the U.S. economy, but for our democratic values as well. 

Biden’s decision to bolster CFIUS is a double-edged sword. While it may protect national security today, it could also give future Administrations the tools to undermine it tomorrow.
