House passes bill targeting CCP trade crimes

The House of Representatives has passed the Protecting American Industry from International Trade Crimes Act, introduced by Rep. Ashley Hinson (R-IA) with support from Chairman John Moolenaar (R-MI) and Ranking Member Raja Krishnamoorthi (D-IL). This legislation aims to address violations of U.S. trade laws by companies based in the People’s Republic of China, which have been accused of engaging in fraud, duty evasion, and transshipment.

The bill seeks to strengthen enforcement against these activities by directing the U.S. Department of Justice (DOJ) to create a new structure focused on prosecuting international trade crimes. The objective is to improve detection, investigation, and prosecution capabilities concerning trade fraud and related offenses.

Chairman Moolenaar emphasized the importance of this legislation on the House floor: "I rise today in support of Congresswoman Hinson’s bill, the Protecting American Industry and Labor from International Trade Crimes Act." He noted that Chinese companies frequently violate U.S. trade laws, undermining American manufacturers and workers.

Moolenaar referred to testimonies heard during a roundtable in Wisconsin last August, where Americans across various industries reported how Chinese companies' illegal practices were affecting their operations. He stated that civil penalties were insufficient deterrents against such activities.

The bill incorporates recommendations made by Ranking Member Krishnamoorthi, Congresswoman Hinson, and other bipartisan committee members for criminal enforcement as a means to counteract economic coercion by the CCP. "Today’s legislation takes that recommendation and turns it into action," said Moolenaar.

He also highlighted collaboration with industry experts, DOJ officials, and House committees in crafting this legislation. Moolenaar expressed commitment to securing necessary funding for prosecutors tasked with enforcing these laws: "In the face of China’s economic onslaught against our country, we must ensure these prosecutors have the resources they need."

The Protecting American Industry from International Trade Crimes Act proposes several measures:

- Establishment of a task force within DOJ's Criminal Division for investigating and prosecuting trade-related crimes.

- Enhancement of nationwide responses through training and technical assistance for law enforcement agencies.

- Requirement for an annual report from the Attorney General assessing DOJ efforts and fund utilization.
