Revision Military Ltd., a corporation based in Delaware with its main operations in Vermont, has agreed to pay $426,000 to settle allegations of violating the False Claims Act. The company was accused of misrepresenting that its eyewear products were entirely sourced from the United States, as required by the Berry Amendment for products sold through the Defense Logistics Agency’s Special Operational Equipment Tailored Logistics Support (SOE TLS) Program.
The investigation revealed that between January 1, 2016, and December 31, 2020, Revision used non-domestic materials for certain components like carrying pouches and straps in their eyewear systems. Revision acknowledged these sales and admitted that employees responsible for product sourcing were aware of using non-compliant components during this period. This conduct was alleged to have violated the False Claims Act.
United States Attorney Nikolas P. Kerest commented on the case: “In selling products that it knew to be non-compliant, Revision violated the trust placed in government contractors in furtherance of its own bottom line.” He also noted that this is one of three investigations into procurement fraud resolved by his office within two years.
The Department of the Army Criminal Investigation Division and the United States Department of Defense Office of Inspector General's Defense Criminal Investigative Service provided investigative support. Keith K. Kelly from the Army's Fraud Field Office emphasized their commitment to protecting soldiers' interests and pursuing procurement fraud aggressively. Patrick J. Hegarty from DCIS highlighted their focus on maintaining integrity in DoD procurement processes.
To address these claims, Revision has agreed to a settlement amount reflecting its responsibility acceptance and cooperation with investigators. The new owners have implemented compliance measures since acquiring Revision after 2019.
