A St. Francis, South Dakota man, Martin Metcalf, has been sentenced to five years in federal prison following a conviction for assault with a dangerous weapon. U.S. District Judge Eric C. Schulte delivered the sentence on December 16, 2024. The punishment includes two years of supervised release and a $100 special assessment payable to the Federal Crime Victims Fund.
Metcalf was indicted by a federal grand jury in December 2023 and entered a guilty plea on September 19, 2024. The charges relate to an incident on November 24, 2023, in Todd County, South Dakota, within the Rosebud Sioux Indian Reservation. During this event, Metcalf reportedly threatened his girlfriend and her children with an AR-15-style rifle and struck his girlfriend on the arm with it. A child called emergency services during the altercation leading to law enforcement's response. Metcalf will relinquish ownership of the firearm to the United States.
The case was prosecuted federally under the Major Crimes Act due to its occurrence in Indian Country, which necessitates federal rather than state prosecution for certain violent crimes.
The prosecution was part of Project Safe Neighborhoods (PSN), an initiative aimed at reducing violent crime and gun violence through community and law enforcement collaboration. The strategy focuses on fostering trust within communities, supporting violence prevention organizations, setting strategic enforcement priorities, and measuring outcomes.
The investigation was conducted by Rosebud Sioux Tribe Law Enforcement Services and the Bureau of Alcohol, Tobacco, Firearms and Explosives. Senior Litigation Counsel Kirk Albertson led the prosecution effort.
Metcalf is now in custody under the supervision of the U.S. Marshals Service.
