DHS extends Temporary Protected Status for Sudan due to ongoing conflict

The Department of Homeland Security (DHS) has announced an extension of Temporary Protected Status (TPS) for Sudan, effective for 18 months. This decision comes in response to ongoing armed conflict and conditions that make it unsafe for individuals to return.

Following a review of the situation in Sudan and consultations with interagency partners, DHS determined that an extension is necessary due to continued political instability leading to human rights abuses. "Militias have targeted fleeing civilians, murdering innocent people escaping conflict, and prevented remaining civilians from accessing lifesaving supplies," according to the department. These factors prevent safe repatriation for Sudanese nationals and habitual residents.

Approximately 1,900 current eligible beneficiaries can re-register for TPS if they meet eligibility requirements. Re-registration is open only to those who previously registered under Sudan’s designation and have been residing in the United States since at least August 16, 2023.

Individuals processed by DHS undergo thorough national security and public safety vetting during both the initial application process and re-registration. Those identified as threats may face detention or removal. Convictions of any felony or two misdemeanors disqualify individuals from TPS.

Acknowledging potential delays in receiving new Employment Authorization Documents (EAD), DHS is automatically extending the validity of EADs issued under Sudan's TPS designation by 12 months.

U.S. Citizenship and Immigration Services (USCIS) will continue processing pending applications filed under the Sudan designation. Applicants with pending Form I-821 or Form I-765 do not need to refile. Approved applicants will receive TPS through October 19, 2026, along with valid EADs until the same date.
