U.S. District Judge Lydia Kay Griggsby has sentenced Erbeth Gomez-Delgado, a 48-year-old resident of Hyattsville, Maryland, to 24 months in federal prison for illegally reentering the United States after deportation. Gomez-Delgado was previously convicted of child sexual abuse.

The sentence follows a November 2024 verdict by a federal jury that found Gomez-Delgado guilty of reentry after deportation. U.S. Attorney for the District of Maryland, Erek L. Barron, announced the sentencing alongside Matthew Davies, Acting Director of Field Operations at the U.S. Customs and Border Patrol's Baltimore Field Office.

Trial evidence revealed that U.S. Customs and Border Patrol first encountered Gomez-Delgado on July 29, 2016, as he crossed into the U.S. via the Rio Grande in Texas without inspection. He was subsequently deported to Guatemala on the same day.

However, on February 15, 2019, authorities discovered that Gomez-Delgado had returned to the U.S., following his arrest for sexually abusing a minor in Prince George’s County. During his trial for illegal reentry, prosecutors demonstrated that he had unlawfully reentered the country before February 2019 without seeking or receiving permission from either the Attorney General or the Secretary of Homeland Security.

U.S. Attorney Barron expressed gratitude to U.S. Customs and Border Patrol for their role in both investigating and bringing this case to trial. He also thanked Assistant U.S. Attorney LaShanta Harris and Department of Justice Trial Attorney Shriram Harid for prosecuting the case.
