United States Attorney Mac Schneider has announced a settlement between the U.S. Attorney’s Office for the District of North Dakota and Mandan Parks and Recreation. The agreement addresses allegations that parts of the Starion Sports Complex violate the Americans with Disabilities Act of 1990 (ADA). Opened in 2017, the facility includes ice rinks, a gymnastics center, and various athletic fields.
The investigation by the U.S. Attorney’s Office revealed that the Starion Sports Complex did not have an accessible path to visitor seating at its football field. Additionally, accessible seating at the competition ice rink was not integrated into the seating plan. Other areas such as toilet rooms, concourse, skate rental counter, outdoor picnic area, and assistive listening systems were also found to be non-compliant with ADA requirements.
Under the terms of the settlement, Mandan Parks and Recreation will provide adequate wheelchair and companion seating and address all identified violations.
“Protecting access for individuals with disabilities is a priority for the United States Attorney’s Office,” stated U.S. Attorney Schneider. He acknowledged Mandan Parks and Recreation's cooperation throughout the investigation and commended their commitment to addressing ADA violations promptly.
The case was managed by Assistant United States Attorneys Melissa H. Burkland and Tara Vavrosky Iversen along with Paralegal Specialist Michelle Erdmann.
