Huntington man sentenced for fentanyl distribution and supervised release violation

William S. Thompson U.S. Attorney | U.S. Attorney for the Southern District of West Virginia

Tyson Davis Sr., a 45-year-old resident of Huntington, West Virginia, received a prison sentence of seven years and two months. This will be followed by three years of supervised release due to his involvement in distributing fentanyl and violating the terms of his supervised release.

Court documents reveal that on June 14, 2023, Davis sold approximately 2.93 grams of fentanyl to a confidential informant while in a parked vehicle in Huntington. He admitted to this transaction. Investigators arranged three additional controlled purchases with Davis using the same informant on June 8, August 3, and October 24, 2023. Over these four transactions, Davis sold a total of 24.057 grams of substances containing fentanyl.

Laboratory tests confirmed that the drugs sold by Davis on June 8 and June 14 were at least 58 percent pure fentanyl, while those sold on August 3 were at least 46 percent pure. Investigators noted that seized fentanyl typically ranges from only 0.5 percent to 7 percent purity.

Davis has an extensive criminal record with multiple convictions related to drugs and firearms offenses. At the time he committed this offense, he was under supervised release following his May 17, 2021 conviction for possession of a firearm in furtherance of drug trafficking. The current sentence includes two years and six months for committing another crime while on supervised release.

United States Attorney Will Thompson announced the sentencing and praised the investigative efforts by the Federal Bureau of Investigation (FBI), Cabell County Sheriff's Office, and Drug Enforcement Administration (DEA). United States District Judge Robert C. Chambers delivered the sentence with Assistant United States Attorney Lesley C. Shamblin prosecuting the case.
