Honduran man pleads guilty to illegal reentry into the United States

William S. Thompson U.S. Attorney | U.S. Attorney for the Southern District of West Virginia

Nolvin Alfredo-Diaz, a 42-year-old Honduran national, has pleaded guilty to the charge of reentry of a removed alien. The plea was entered in Beckley, West Virginia.

Court documents reveal that U.S. Immigration and Customs Enforcement (ICE) agents arrested Alfredo-Diaz on August 21, 2024, in Lewisburg. He admitted to being in the United States illegally and acknowledged previous deportations. Alfredo-Diaz lacked identification documents granting him legal status in the country.

Fingerprint analysis confirmed two prior removals of Alfredo-Diaz from the United States to Honduras. The first removal occurred on December 27, 2006, following a felony conviction for possession of heroin in Denver County, Colorado. A subsequent arrest took place on September 6, 2007, also in Denver, leading to another conviction for cocaine possession on December 20, 2007. He was found again in Canon City, Colorado, on July 21, 2010, and removed from the United States on August 5 of that year.

Alfredo-Diaz did not obtain permission from the Secretary of U.S. Homeland Security to reapply for admission after either removal nor sought legal reentry methods.

Sentencing is scheduled for May 29, 2025. Alfredo-Diaz faces up to ten years in prison and three years of supervised release. Deportation proceedings will follow any sentence served.

United States Attorney Will Thompson stated: “This federal criminal case underscores our office’s commitment to pursuing illegal reentry cases, especially in circumstances where the offender has a criminal history.” He highlighted Alfredo-Diaz's two prior drug-related felony convictions and multiple removals as factors necessitating aggressive prosecution.

The announcement came from Thompson who praised ICE's investigative efforts. United States Magistrate Judge Omar J. Aboulhosn presided over the hearing with Assistant United States Attorney Erik S. Goes prosecuting.
