ICE arrests Guatemalan national charged with serious crimes

U.S. Immigration and Customs Enforcement (ICE) recently apprehended Edilio Agustin-Orellana, a Guatemalan national charged with multiple serious offenses in Brockton, Massachusetts. The charges include five counts of assault with a dangerous weapon, three counts of kidnapping, intimidation, and armed home invasion. Agustin-Orellana was arrested in Providence on January 27.

"Edilio Agustin-Orellana stands accused of some extremely egregious felonies and represents a significant threat to the residents of New England," stated Patricia H. Hyde, acting Field Office Director for ICE Enforcement and Removal Operations in Boston. "We simply cannot tolerate such threats to our residents. ICE Boston remains dedicated to prioritizing the safety of our public by arresting and removing illegal alien offenders from the streets of our communities."

Agustin's history with U.S. immigration authorities dates back to January 25, 2002, when he was first arrested by the U.S. Border Patrol near Brownsville, Texas. He was transferred to Immigration and Naturalization Services at the Port Isabel Detention Center in Los Fresnos, Texas, but released on bond two weeks later.

On September 23, 2002, a Department of Justice immigration judge ordered his removal from the United States to Guatemala. However, Agustin continued to have run-ins with law enforcement in the U.S., including a conviction on October 13, 2004, by the 6th Division District Court in Providence for eluding police and resisting arrest.

Despite being removed from the U.S. twice—once on December 30, 2006, after an arrest at the Rhode Island Adult Correctional Institute in Cranston—and again on February 8, 2008—Agustin illegally reentered the country several times.

His most recent reentry occurred on August 4, 2019. Following an arrest for armed home invasion in Brockton on February 20, 2024, ICE lodged an immigration detainer against him; however, it was not honored by Brockton District Court.

The Plymouth Superior Court arraigned Agustin on June 24, 2024. After remaining at large for several months following his release from custody by Brockton District Court despite ICE's detainer request, he was finally apprehended by ICE agents in Providence this January.

Agustin is currently held in ICE custody as legal proceedings continue.
