Roanoke man sentenced for illegal firearm possession and shooting

Zachary T. Lee Acting United States Attorney | U.S. Attorney for the Western District of Virginia

A Roanoke man has been sentenced to 108 months in federal prison for illegally possessing a firearm, which he used to shoot another individual. James Aaron Haburn, aged 32, was found guilty of possessing a firearm as a convicted felon after a bench trial in October 2024.

Court documents and evidence from the trial indicated that police stopped Haburn in November 2022 during a traffic incident and discovered a stolen Smith & Wesson pistol tucked into his waistband. Further investigation showed that Haburn had used the same weapon 34 hours earlier to shoot someone in the back after an altercation outside a Roanoke business.

The announcement of Haburn's sentencing was made by Acting U.S. Attorney Zachary T. Lee and Anthony Spotswood, Special Agent in Charge of the Washington Field Division of the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF).

The case was investigated by the Roanoke City Police Department along with the ATF. Assistant U.S. Attorney Kelly McGann led the prosecution.
