A Guatemalan national has admitted guilt in a U.S. District Court in Providence for failing to register as a sex offender and re-entering the United States illegally, according to Acting United States Attorney Sara Miron Bloom.
Nelson Leonel Yocute Samayoa, 34, was previously convicted in 2014 in Rhode Island state court for second-degree sexual assault. Following his conviction, he was ordered to register as a sex offender and subsequently deported.
Court documents reveal that after his deportation, Yocute returned to the U.S. without authorization and resided and worked in Newport for nearly nine years. During this period, he did not fulfill the requirement to register as a sex offender, as stipulated by his 2014 sentence.
Yocute has been detained since his arrest on May 14, 2024. His sentencing is scheduled for June 12, 2025. A federal district judge will determine the sentence based on the U.S. Sentencing Guidelines and other legal considerations. Additionally, Yocute will undergo deportation proceedings once more.
Assistant United States Attorney Denise M. Barton is prosecuting the case.
The investigation was conducted by the Newport Police Department with support from Homeland Security Investigations and the United States Marshals Service.
