A Chesapeake man has entered a guilty plea to charges of attempted coercion and enticement of a child. Kyle Andrew Babiak, 31, was involved in communication with an undercover law enforcement officer posing as a 14-year-old girl through a social media application.
Court documents reveal that on February 16, 2024, Babiak began these interactions. During their exchanges, he acknowledged the supposed age of the girl and expressed concerns about potential legal consequences by mentioning he could "wind up in a court martial." Babiak sent a photograph appearing to be in Navy uniform and requested one in return from the person he believed was the minor.
Babiak proposed meeting in person and escalated the conversation to include explicit sexual content. He also sent sexually explicit photos of himself. When informed that the girl's parents were not home, Babiak asked for her address to pick her up and take her back to his residence. He questioned whether her location was tracked by her parents during this planning.
Upon arriving at the provided address, Babiak parked his car and approached the front door where he was arrested by NCIS agents alongside officers from the Hampton Police Department.
Babiak is scheduled for sentencing on July 24. He faces a mandatory minimum sentence of 10 years with potential for life imprisonment. The actual sentence will be determined by a federal district court judge who will consider various guidelines and statutory factors.
The announcement followed U.S. District Judge Elizabeth W. Hanes's acceptance of Babiak's plea. The case is prosecuted by Assistant U.S. Attorney Peter G. Osyf under Project Safe Childhood, an initiative launched in May 2006 aimed at combating child sexual exploitation online.
