Dominican national indicted for illegal reentry into the United States

A Dominican national residing in Methuen has been indicted by a federal grand jury in Boston for allegedly reentering the United States illegally after deportation. Florencio Antonio Nuñez Guerrero, 37, faces one count of unlawful reentry of a deported alien. Currently held on unrelated charges, Nuñez Guerrero will appear in federal court in Boston at a future date.

The indictment states that Nuñez Guerrero was deported from the U.S. on March 3, 2017, following a federal sentence for conspiracy to possess with intent to distribute cocaine and heroin. He is accused of returning to the U.S. without permission sometime after his removal.

If convicted, the charge could result in up to 20 years in prison, three years of supervised release, and a fine up to $250,000. Following any imposed sentence, he would be subject to deportation. Sentencing is determined by a federal district court judge based on U.S. Sentencing Guidelines and relevant statutes.

The announcement was made by United States Attorney Leah B. Foley and Patricia H. Hyde, Field Office Director of U.S. Immigration and Customs Enforcement’s Enforcement and Removal Operations in Boston. Assistant U.S. Attorney Sandra Gonzalez Sanchez from the Major Crimes Unit is handling the prosecution.

It is important to note that "the details contained in the charging documents are allegations," and "the defendant is presumed innocent unless and until proven guilty beyond a reasonable doubt in a court of law."
