Florida woman admits guilt in $90M offshore tax evasion scheme

A Florida woman has admitted to conspiring with her family to hide over $90 million in offshore bank accounts from the IRS. Gilda Rosenberg, a dual U.S. and Colombian citizen residing in Golden Beach, Florida, pleaded guilty to defrauding the United States by concealing foreign financial accounts, filing false tax returns, and evading taxes.

Court documents reveal that between 2010 and 2022, Rosenberg collaborated with two family members to keep assets and income undisclosed in bank accounts located in Andorra, Israel, Panama, and Switzerland. The family's offshore accounts date back to the 1970s. By the late 1990s, Rosenberg was aware of their non-disclosure of these accounts to U.S. authorities and their failure to pay taxes on the income generated.

In the early 2000s, the family consolidated their assets at Credit Suisse in Switzerland and the UK. They informed Credit Suisse employees about their status as U.S. persons aiming to conceal assets from U.S. authorities. The accounts were closed by Credit Suisse in 2013 due to their U.S. citizenship.

Following this closure, the family transferred their assets—often titled under nominee entities—to new accounts at Bank Leumi in Israel, Union Bancaire Privée (UBP), PKB Privat Bank SA in Switzerland, and an Andorran bank. Rosenberg was recorded as a beneficial owner of some of these accounts but falsely claimed Colombian residency on account opening documents.

Rosenberg and her relatives failed to file Reports of Foreign Bank and Financial Accounts (FBARS) as required by law and continued submitting false tax returns omitting offshore income.

In a bid to continue evading tax obligations around 2017, they divided family assets among themselves under false pretenses after one relative renounced his U.S. citizenship. They also attempted covert asset transfers within the United States using fake loan and investment documents.

Between 2010 and 2017, Rosenberg filed fraudulent tax returns excluding over $5.5 million earned from her assets at UBP resulting in a $1,927,342 tax loss for the IRS.

Rosenberg's sentencing is scheduled for May 30 where she faces up to five years imprisonment along with supervised release terms, restitution obligations, and monetary penalties pending determination by a federal district court judge considering relevant guidelines.

Previously convicted for conspiracy related wire fraud against Army & Air Force Exchange Service (AAFES) in Texas under case number United States v. Rosenberg (4:24-cr-00062-ALM-AGD), this adds another layer of legal challenges for Rosenberg.

The announcement was made by U.S Attorney Hayden P O’Byrne for Southern District Florida alongside Acting Deputy Assistant Attorney General Karen E Kelly from Justice Department’s Tax Division who acknowledged IRS Criminal Investigation’s International Tax & Financial Crimes Unit's involvement supported critically by Justice Department’s Office International Affairs securing key evidence.
