Kenny Fernando Castillo, a 29-year-old, was sentenced to 12 months in prison following his arrest by the Foley Police Department on December 14, 2024. Castillo was apprehended for drunken driving and later identified as not being a United States citizen. Immigration and Customs Enforcement (ICE) confirmed that Castillo had been previously deported from the U.S. in 2018 and had a prior DUI conviction from 2017.
Judge Moorer handed down the sentence which includes a one-year term of supervised release after his incarceration. Upon release, Castillo will be referred to immigration officials for deportation proceedings. Additionally, he has been ordered to pay $100 in special assessments.
The announcement was made by U.S. Attorney Sean P. Costello of the Southern District of Alabama. The investigation involved multiple agencies including the Department of Homeland Security, Homeland Security Investigations, Immigrations and Customs Enforcement, and Foley Police Department.
Assistant U.S. Attorney Kacey Chappelear prosecuted the case on behalf of the United States. This legal action is part of Operation Take Back America, an initiative aimed at combating illegal immigration and protecting communities from violent crime associated with cartels and transnational criminal organizations.
