An Oklahoma City resident, Nicois Megale Smith, 40, has received a federal prison sentence totaling 84 months for possessing a firearm illegally after a prior felony conviction. This announcement was made by U.S. Attorney Robert J. Troester.
This legal action follows a series of events initiated on August 16, 2023, when a federal grand jury brought forth an indictment involving three counts. Smith was charged with two counts of being a felon in possession of a firearm, while his father, Albert Smith Jr., 62, faced one count related to the same offense. On June 10, 2024, Albert admitted guilt to possessing a firearm in May 2023, which he suspected was stolen. Nicois was subsequently found guilty on June 12, 2024, of one count after a trial.
The trial revealed that on May 21, 2023, the Oklahoma City Police Department investigated a crime near Nicois’s residence. A search led to the discovery of a loaded pistol linked to Nicois. The trial also highlighted the duo's extensive criminal history, evidenced by Nicois having multiple convictions, including for offenses such as possession with intent to distribute controlled substances and firearms, and Albert with numerous felony convictions.
In a sentencing event on March 24, 2025, Nicois received his 84-month prison sentence and a subsequent three-year supervised release. His father, Albert, also received an identical sentence of 84 months on October 31, 2024. The court emphasized their high recurrence of criminal activity as a factor.
Investigations involved the Bureau of Alcohol, Tobacco, Firearms, and Explosives and the Oklahoma City Police Department, with prosecution led by Assistant U.S. Attorneys Daniel Gridley, Elizabeth M. Bagwell, and Travis Leverett. This case aligns with Project Safe Neighborhoods, a Department of Justice initiative aimed at reducing violent crime.
