U.S. Attorney Michael DiGiacomo has announced the arrest of 39-year-old Kyle Stack from Medina, New York. Stack faces charges of possession of child sexual abuse material involving prepubescent minors. If convicted, the charges carry a potential sentence of up to 20 years in prison and a $250,000 fine.
Assistant U.S. Attorney Charles M. Kruly, in charge of prosecuting the case, reported that the investigation began in December 2019. Adobe Systems Inc. notified authorities after four illegal images were uploaded to their servers by a user identified as "Kyle Stack." Further investigation linked the uploads to the defendant. A search warrant was executed by the New York State Police at Stack's Bates Road home in July 2020, resulting in the seizure of six electronic devices. Forensic analysis revealed that two of these devices contained illegal material. Stack's cell phone contained 4,822 images and 32 videos of child sexual abuse material, 2,319 images and four videos of child erotica, and 25 animated child sexual abuse material. Additionally, his laptop held 3,476 images, eight animated images, 16 images of child bestiality and bondage, 5,930 videos, three animated videos, and 43 child bestiality and bondage videos.
Stack appeared before U.S. Magistrate Judge Jeremiah J. McCarthy and was subsequently detained.
The investigation was conducted by the New York State Police, led by Major Amie Feroleto, and the Federal Bureau of Investigation, led by Special Agent-in-Charge Matthew Miraglia.
Authorities emphasize that charges are accusations, and all defendants are presumed innocent unless proven guilty.
