The U.S. Department of Labor has successfully recovered over $1.4 million in back wages for 2,620 employees following an investigation into a San Jose-based electrical engineering and construction company. The department found that Cupertino Electric Inc., one of California's largest electrical contractors, failed to pay proper overtime rates as required by the Fair Labor Standards Act.

The Wage and Hour Division of the department discovered that Cupertino Electric Inc. did not include non-discretionary bonuses when calculating overtime pay rates, leading to this substantial wage recovery. "The U.S. Department of Labor is committed to making sure employees are paid properly, including the full amount of their legally required overtime rates," stated Wage and Hour Division Assistant District Director Lilita Hom in San Jose.

Cupertino Electric, a subsidiary of Quanta, specializes in designing and building complex electrical systems for both private and public sector clients across several states including Arizona, California, Idaho, Indiana, Iowa, Michigan, New Mexico, Ohio, Oregon, Utah, and Washington.

For more information on employee rights enforced by the division or inquiries regarding wage concerns, individuals can contact the toll-free helpline at 866-4US-WAGE (487-9243). Additionally, the agency offers a free Timesheet App available on Android and iOS devices to help ensure accurate tracking of hours and pay.
