Acting United States Attorney Michael M. Simpson announced that Marlon Santos, a 36-year-old native of Honduras, was indicted on May 8, 2025, for re-entry of a removed alien. The charge is in violation of Title 8, United States Code, Section 1326(a).
Court documents reveal that Santos was found in Orleans Parish on April 21, 2025. He had been previously deported to Honduras on December 21, 2018.
If convicted, Santos could face up to two years in prison and a fine of up to $250,000. Additionally, he may be subject to three years of supervised release and a mandatory special assessment fee of $100.
Simpson emphasized that an indictment is merely a charge and the defendant's guilt must be proven beyond a reasonable doubt.
This case is part of Operation Take Back America. This nationwide initiative uses the full resources of the Department of Justice to combat illegal immigration and aims for the elimination of cartels and transnational criminal organizations. It also seeks to protect communities from violent crime perpetrators. The operation integrates efforts from the Department’s Organized Crime Drug Enforcement Task Forces and Project Safe Neighborhood.
Simpson commended the U.S. Department of Homeland Security for their investigation into this matter. Assistant United States Attorney Spiro G. Latsis from the General Crimes Unit is handling the prosecution.
