Michele Beckwith Acting U.S. Attorney | U.S. Attorney for the Eastern District of California
A federal grand jury has indicted Preston Nelson-Kestner, 21, from Oakhurst on charges of stalking and distributing and possessing images of child sexual exploitation. The announcement was made by Acting U.S. Attorney Michele Beckwith.
Court documents reveal that between October 2023 and February 13, 2024, Nelson-Kestner allegedly used social media platforms like OnlyFans, Instagram, and TikTok to engage in conduct aimed at causing substantial emotional distress to an adult victim in Fresno. He reportedly sent threatening messages as well as videos and images depicting a minor engaged in sexually explicit activities.
The case results from an investigation conducted by the Federal Bureau of Investigation and the Fresno Police Department. Assistance was provided by the Madera County Sheriff’s Office and the Central California Internet Crimes Against Children Task Force. Assistant U.S. Attorney David L. Gappa is leading the prosecution.
Nelson-Kestner could face severe penalties if convicted: up to five years in prison for stalking, a minimum of five years up to 20 years for distribution, and a maximum of ten years for possession of exploitative images. Sentencing will be determined based on statutory factors and Federal Sentencing Guidelines after conviction. It is important to note that these charges are allegations, and Nelson-Kestner is presumed innocent until proven guilty beyond a reasonable doubt.
