Felon sentenced for unlawful possession of ammunition after firing gun outside S.F. bar

Fernando Aguilera has been sentenced to 45 months in federal prison for unlawful possession of ammunition. Senior U.S. District Judge William Alsup delivered the sentence.

Aguilera, a 37-year-old Honduran national, was indicted by a federal grand jury on July 18, 2023. On February 12, 2025, Judge Alsup found him guilty of being a felon in possession of ammunition under 18 U.S.C. § 922(g)(1) following a bench trial. Evidence presented at the trial revealed that Aguilera had brandished a gun at a crowded bar in San Francisco and subsequently fired it into the air twice outside, with people and vehicles nearby. Upon law enforcement's arrival, Aguilera attempted to flee but was apprehended in the garden area of a nearby residence. A firearm with an incorrect caliber bullet lodged in its chamber was found next to him, along with ammunition in his bag. At the time of his arrest, Aguilera had four prior felony convictions for accessory charges, possessing ammunition as a prohibited person, and second-degree burglary.

The announcement was made by United States Attorney Craig H. Missakian and FBI Special Agent in Charge Sanjay Virmani.

In addition to the prison term, Judge Alsup imposed a three-year supervised release period on Aguilera. He has been detained since committing the offense.

Assistant U.S. Attorneys Kelsey Davidson and Sophia Cooper prosecuted the case with support from Kevin Costello and Marina Ponomarchuk. The prosecution stemmed from an investigation conducted by the FBI and San Francisco Police Department.
