U.S. Attorney Michael DiGiacomo announced that Gendry Amilcar Niz-Niz, a 25-year-old from Guatemala, has pleaded guilty to making a false statement in court. The plea was entered before U.S. District Judge John L. Sinatra, Jr., and Niz-Niz was sentenced to time served before being handed over to Immigration and Customs Enforcement.
Assistant U.S. Attorney Sasha Mascarenhas explained that the incident occurred on March 16, 2025, during a traffic stop where Niz-Niz provided law enforcement with a name and identification card that did not match his true identity. His real identity was discovered through fingerprint analysis and immigration checks conducted during the stop.
The investigation is part of Operation Take Back America, an initiative by the Department of Justice aimed at combating illegal immigration, dismantling cartels and transnational criminal organizations (TCOs), and protecting communities from violent crime.
The case involved efforts from the Lockport Police Department, led by Chief Steven Abbott, and the U.S. Border Patrol under Patrol Agent-in-Charge Martin B. Coombs.
