Small businesses see mixed results in Supreme Court's latest term

The recent term of the U.S. Supreme Court, spanning 2024-2025, saw modest engagement with issues directly impacting small businesses. However, the National Federation of Independent Business (NFIB) Legal Center maintained its advocacy efforts on behalf of these enterprises. Out of these seven cases, the NFIB achieved three victories, faced three losses, and experienced one neutral outcome. Beth Milito, Vice President and Executive Director of NFIB’s Small Business Legal Center, commented on the outcomes: “The Supreme Court’s 2024-2025 term was a mixed bag for small business owners.” She acknowledged some disappointing results but highlighted several favorable decisions: "the Court’s decisions reining in administrative agencies, protecting access to courts for indirectly regulated parties, and refusing to impose a heightened evidentiary burden on employers for Fair Labor Standards Act (FLSA) exemptions were promising and much-needed victories for Main Street.”
