Court dismisses lawsuit against deportation of Colorado terrorist's family

A federal court has dismissed a lawsuit seeking the release of the family of Mohamed Sabry Soliman, who was involved in an anti-Semitic attack in Boulder, Colorado. The decision paves the way for their deportation.

The ruling was issued on Wednesday by U.S. District Judge Orlando Garcia, who stated that "the Court finds that Petitioners’ habeas proceeding and their claims in this case must be and hereby are DISMISSED WITHOUT PREJUDICE. This case is CLOSED."

Assistant Secretary Tricia McLaughlin commented on the outcome: “This is a proper end to an absurd legal effort on the plaintiff’s part. Just like her terrorist husband, she and her children are here illegally and are rightfully in ICE custody for removal as a result.” She also mentioned ongoing investigations into whether Soliman's family had prior knowledge or provided support for the attack.

Soliman attacked a pro-Israel demonstration using Molotov cocktails and a homemade flamethrower on June 1, resulting in injuries to several demonstrators. One of those injured, 82-year-old Karen Diamond, died from her injuries later that month. Soliman faces over 70 charges including first-degree murder, first-degree assault, and committing a hate crime.

After his arrest, it was revealed that Soliman was residing in the United States illegally with an expired visa along with his wife and five children. They were detained by ICE for removal proceedings but initially received a temporary reprieve from deportation by U.S. District Court Judge Gordon Gallagher on June 4.

McLaughlin assured that "this terrorist will be prosecuted to the fullest extent of the law" while expressing ongoing support for victims: "We are continuing to pray for the victims of this attack and their families."
