Maine man pleads guilty to distributing THC-laced ice cream

A Maine man has admitted guilt in a federal court in Concord for his role in producing THC-laced ice cream that led to the illness of four individuals in Newmarket. Acting U.S. Attorney Jay McCormack made the announcement.

Marc Flore, 45, from Portland, Maine, pleaded guilty to tampering with consumer products. Chief U.S. District Court Judge Landya McCafferty has set his sentencing for November 4, 2025.

Court documents and statements revealed that in March 2023, four people became ill after consuming coffee Oreo ice cream from Angelo’s Amore. Symptoms included dizziness, elevated heart rate, vomiting, and three were briefly hospitalized. The investigation found that the ice cream batch contained THC, which Flore added during its production in September 2022. Although meant for personal use, Flore stored it with commercial ice cream without labeling it as containing THC. As a result, staff unknowingly served the tainted ice cream to customers.

The statute under which Flore is charged allows for up to 10 years imprisonment and a maximum fine of $250,000. Sentences are determined by a federal district court judge based on U.S. Sentencing Guidelines and statutes governing criminal cases.

The investigation was led by the Food and Drug Administration (FDA) Office of Criminal Investigations and the Newmarket Police Department. Assistant U.S Attorney Charles L. Rombeau is handling the prosecution.
