A man from South Texas has been sentenced to 20 years in prison for possessing images of sexual assaults involving prepubescent children. This sentencing follows an investigation by the U.S. Immigration and Customs Enforcement (ICE) Homeland Security Investigations Rio Grande Valley Child Exploitation Task Force, with support from the U.S. Border Patrol, Raymondville Police Department, and Willacy County Sheriff’s Office.
Jose Rodriguez Jr., 44, from Lyford, Texas, was sentenced on July 16 by U.S. District Judge Drew Tipton to a total of 240 months in prison. During the hearing, additional information was presented about Rodriguez's prior conviction for aggravated sexual assault of a child. The court took into account his previous conduct which involved tying up a 9-year-old victim before attempting to sexually assault her and restraining an 8-year-old witness. These actions contributed to the decision for an upward departure in sentencing.
The court also noted that Rodriguez had downloaded child pornography files on at least 20 occasions starting just six months after completing a previous 13-year sentence for aggravated sexual assault of a child. The need to protect the public and Rodriguez's lack of remorse were highlighted during sentencing.
Mark Lippa, ICE HSI Rio Grande Valley Deputy Special Agent in Charge, stated: “Homeland Security Investigations remains unwavering in its mission to protect children from exploitation... HSI will continue to work with our partners to ensure offenders are brought to justice and vulnerable victims are safeguarded.”
U.S. Attorney Nicholas J. Ganjei remarked: “Those who sexually assault children... possess child sexual abuse material... or smuggle human beings like some sort of commodity are all imbued with a common trait: total disdain for the inherent value and dignity of a human being.” He emphasized that prosecutors succeeded in securing the maximum possible sentence.
Rodriguez was found guilty after only 15 minutes of jury deliberation following a one-day trial on April 15.
Court documents reveal that Rodriguez must pay restitution to known victims and will be subject to supervised release for life after serving his prison term, with restrictions on access to children and the internet as well as sex offender registration requirements.
Rodriguez was initially arrested on August 12, 2024, related to an alien transportation event where authorities seized his phone containing over 150 images and videos depicting child sexual abuse material.
During trial proceedings, evidence showed multiple downloads of such material linked directly back to Rodriguez through more than 100 user accounts associated with him across several months leading up until August last year; these findings contradicted defense claims suggesting viruses were responsible instead—a computer forensic expert testified this pattern indicated intentional downloading behavior throughout said period under review here today
