Two foreign nationals charged with illegal reentry after prior removals

Mexican and Honduran nationals living in Las Vegas appeared in federal court on Monday, facing charges of illegally reentering the United States after being previously removed. Jose Luis Ruiz-Gutierrez, 39, and Samir Adrian Hernandez-Padilla, 39, are each charged with one count of deported alien found in the United States. Their preliminary hearings are set for August 18, 2025, before U.S. Magistrate Judge Brenda N. Weksler.

According to criminal complaints and statements made during court proceedings, both men had been deported from the United States before returning without authorization. Ruiz-Gutierrez is a citizen of Mexico who was remanded to U.S. Immigration and Customs Enforcement (ICE) custody on July 23, 2025. He was transferred from the Clark County Detention Center following his arrest by North Las Vegas Police Department officers on four counts of sex assault against a child under 16 and lewdness by a person over 18 with a child under 14. Records indicate that he had previously been deported three times: February 15, 2011; May 3, 2011; and December 24, 2013. He also has prior felony convictions for drug trafficking and for being a deported alien found in the United States.

Hernandez-Padilla is a citizen of Honduras who was taken into ICE custody on July 18, 2025 from the Nevada Department of Corrections after an ICE detainer was issued. On August 21, 2020, ICE learned that Hernandez-Padilla had been arrested by the Nevada Department of Wildlife and Las Vegas Metropolitan Police Department for watercraft driving under the influence resulting in death. He had previously been deported to Honduras on December 12, 2013.

If convicted, Ruiz-Gutierrez could face up to twenty years in prison along with supervised release and fines; Hernandez-Padilla faces up to two years imprisonment if convicted.

Acting United States Attorney Sigal Chattah for the District of Nevada and Salt Lake City Field Office Director Jason Knight announced these charges.

The case is being investigated by ICE’s Salt Lake City office in Las Vegas and prosecuted by the U.S. Attorney’s Office for the District of Nevada.
