Montgomery man sentenced to federal prison for illegal machinegun possession

Kevin P. Davidson, U.S. Attorney | U.S. Attorney for the Middle District of Alabama

A Montgomery man has been sentenced to federal prison for illegally possessing a machinegun, according to an announcement from Acting United States Attorney Kevin Davidson. On August 19, 2025, Alazavia Devontae Berry, age 23, received a sentence of 30 months in prison. After serving his prison term, Berry will be under supervised release for three years. Federal sentences do not allow for parole.

Court records show that on September 8, 2024, members of the Metro Area Crime Suppression (MACS) Unit tried to stop a vehicle in Montgomery due to a traffic violation. The driver, identified as Berry, did not stop and led officers on a high-speed chase through a residential area. He left the moving vehicle, which then struck the outside of a nearby house, and attempted to escape on foot. MACS agents apprehended him and found a firearm with a machinegun conversion device hidden in his clothing.

Berry pleaded guilty to unlawful possession of a machinegun on April 11, 2025.

The case was investigated by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF), the Alabama Law Enforcement Agency, and the Montgomery Police Department as part of the MACS Unit. Assistant United States Attorney Paul Markovits prosecuted the case.
