Department of Defense shifts troop support for ICE from Title 10 to Title 32

The Department of Defense (DoD) has announced a shift in the duty status of military personnel who are supporting U.S. Immigration and Customs Enforcement (ICE) in its immigration law enforcement efforts. The change will move these service members from Title 10 to Title 32 status, affecting the current 1,200 authorized troops and adding 500 more, for a total of about 1,700 personnel.

According to the DoD, this decision was made after planning with ICE partners showed that some operational needs require direct contact with individuals held by ICE. The department said that Title 32 status gives military personnel the necessary authority for these duties.

"As part of this transition, Title 10 personnel from the Marine Corps and Naval Reserve who have been providing invaluable support will return to their home stations. National Guard members, in a Title 32 status, will seamlessly take over these vital mission roles to ensure continuity of support and operations," said Chief Pentagon Spokesman Sean Parnell.

The ongoing assistance responds to a May 9, 2025 request from the Department of Homeland Security. Military personnel are helping with case management, transportation and logistics, as well as clerical tasks related to processing individuals at ICE detention centers.

"By providing these crucial services, DoD military personnel directly enable ICE to dedicate more trained agents to core law enforcement activities, significantly enhancing overall effectiveness. The Department of Defense is committed to supporting the Department of Homeland Security in its mission to maintain the security of our borders and enforce immigration laws," Parnell added.
