Mexican national indicted for firearm possession while unlawfully residing in Longview

A Mexican national living unlawfully in Longview, Texas, has been indicted for being an illegal alien in possession of a firearm. The announcement was made by Acting U.S. Attorney Jay R. Combs for the Eastern District of Texas.

Humberto Hernandez-Fornue, 43, was named in an indictment returned by a federal grand jury this week. The indictment alleges that on August 14, 2025, Hernandez-Fornue was found illegally present in the Eastern District of Texas and in possession of a firearm.

According to the U.S. Attorney’s Office, "This case is part of Operation Take Back America, a nationwide initiative that marshals the full resources of the Department of Justice to repel the invasion of illegal immigration, achieve the total elimination of cartels and transnational criminal organizations (TCOs) and protect our communities from the perpetrators of violent crime. Operation Take Back America streamlines efforts and resources from the Department’s Organized Crime Drug Enforcement Task Forces (OCDETFs) and Project Safe Neighborhood (PSN)."

If convicted, Hernandez-Fornue could face up to 15 years in federal prison.

The investigation is being conducted by several agencies: the Bureau of Alcohol, Tobacco, Firearms, and Explosives; the Drug Enforcement Administration; Homeland Security Investigations; and the Tyler Police Department. Assistant U.S. Attorney Dustin Farahnak is prosecuting the case.

Officials emphasized that "A federal indictment is not evidence of guilt. All defendants are presumed innocent until proven guilty beyond a reasonable doubt in a court of law."
