Antonio Gutierrez, a 29-year-old Buffalo resident, has been sentenced to 132 months in federal prison after being convicted of possession with intent to distribute fentanyl. The sentence was handed down by U.S. District Judge Lawrence J. Vilardo.
The case stems from the death of an individual identified as C.R., who was found deceased from a drug overdose on December 9, 2022, at his home in Orchard Park, New York. Law enforcement officials recovered suspected fentanyl, drug paraphernalia, and other items from the scene. Investigators also found Gutierrez’s DNA on a glassine envelope in the bedroom where C.R. was discovered.
According to Assistant U.S. Attorney P. Richard Antoine, communications between C.R.’s phone and a number linked to Gutierrez were frequent leading up to the overdose. Both phones were located in the same area of Buffalo in the hours before C.R.'s death.
U.S. Attorney Michael DiGiacomo stated: "Antonio Gutierrez, 29, of Buffalo, NY, who was convicted of possession with intent to distribute fentanyl, was sentenced to serve 132 months in prison by U.S. District Judge Lawrence J. Vilardo."
The investigation was conducted by Homeland Security Investigations and the Orchard Park Police Department.
