An Ecuadorian national living unlawfully in Lawrence, Massachusetts, has been sentenced to six months in federal prison for illegally reentering the United States after being deported. Carlos Guaico-Bano, 35, received his sentence from U.S. District Court Judge Allison D. Burroughs and will be subject to one year of supervised release following his prison term. He is also subject to deportation upon completion of his sentence.
Guaico-Bano pleaded guilty in June 2025 to one count of unlawful reentry of a deported alien. Authorities reported that he had attempted to enter the United States six times and was previously arrested in Lawrence in November 2021 on state charges of assault and battery. He received an 18-month suspended sentence for those charges but was released from state custody without immigration authorities being notified.
Federal records show that Guaico-Bano was encountered by Border Patrol agents multiple times in Texas locations including Brackettville, Eagle Pass, and El Paso between February and March 2020. Each time, he was found to have no legal right to remain in the country and was returned across the border into Mexico.
On March 3, 2020, after another encounter with Border Patrol, Guaico-Bano was served with a Notice to Appear at removal proceedings scheduled for March 10, 2020. Instead of appearing as directed, he attempted another unauthorized entry into the United States and was placed into custody before being removed back to Ecuador on the same day.
He made a sixth attempt at illegal entry in September 2020 but was again apprehended and removed to Ecuador.
Immigration authorities learned that Guaico-Bano had reentered the country illegally after his arrest on November 17, 2021, for assault-related offenses in Lawrence. Although convicted and given a suspended sentence, he was released before immigration officials could intervene.
United States Attorney Leah B. Foley stated: "United States Attorney Leah B. Foley and Patricia H. Hyde, Field Office Director of U.S. Immigration and Customs Enforcement’s Enforcement and Removal Operations in Boston made the announcement." Assistant U.S. Attorney Luke A. Goldworm prosecuted the case.
